Terms of Service
These Terms of Service ("Terms") govern your use of the FamilyGuard by Trisha AI mobile application, the website at familyguardsafety.com, and any related services (collectively, the "Service"), all operated by Godhead Safety Consulting LLC, a Texas limited liability company ("FamilyGuard," "we," "us," or "our").
By creating an account, joining a family circle, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Read this first — the most important disclaimer in this entire agreement.
FamilyGuard is a best-effort predictive-alert tool. It is not a guarantee, a warranty, an emergency service, a medical device, a security service, or a substitute for safe driving, parental supervision, attention to the road, or 9-1-1. Alerts may be late, missed, wrong, or never fire at all for many reasons — including but not limited to: app crashes; server outages; loss of cellular signal; dead phone battery; the user disabling notifications, location services, or background app refresh; the user force-quitting the app; the user ignoring an alert that did fire; the user being asleep or otherwise unable to respond; phone OS limitations on background processing; the user being outside the United States or in an unsupported region; inaccurate or stale third-party data (weather, traffic, road, intersection, mapping); software bugs; hardware failures; or any other condition outside our reasonable control.
By using FamilyGuard you accept all of these risks. You agree not to rely on the Service as your only or primary safety system. If you do not accept these risks, do not use the Service.

01Acceptance and eligibility
You must be at least 18 years old to create a FamilyGuard account as a family owner or to enter into a subscription agreement. Family members who are minors (ages 13–17) may use the Service only with the consent and supervision of a parent or legal guardian who is the family owner. Children under 13 may not use the Service except as passive location-only members in a family circle managed by their parent or guardian.
By using the Service, you represent that you meet these age requirements and that you have the legal capacity to enter into a binding contract.
02Your account and family circle
You are responsible for: (a) keeping your login credentials confidential; (b) all activity that happens under your account, whether or not you authorized it; (c) ensuring that the information you provide about yourself, your family members, and your devices is accurate and kept up to date; and (d) ensuring that every family member you invite is aware that you are sharing their location and driving telemetry with the rest of the family circle, and has consented to such sharing.
A family circle can include up to 2 members on the Basic tier, 5 members on the Pro tier, or 10 members on the Family tier. The family owner has administrative control over the circle and may add, remove, or change the role of other members at any time.
You must notify us promptly at support@familyguardaiapp.com if you suspect your account has been compromised.
03Subscriptions, trials, and billing
Plans and prices
- Basic — Free. Includes live family map, real-time location sharing, up to 2 family members, and an SOS button. No subscription required.
- Pro — $15.99 per month. Unlocks all predictive safety features (Weather Intercept, Live Risk Score, voice alerts, Speed Limit Drop Warning, Dangerous Intersection alerts, Auto-911 Crash Detection, school-zone proximity, offline-while-driving detection, 30-day trip history, insurance safety reports) and increases family-member capacity to 5.
- Family — $24.99 per month. Everything in Pro, plus family-wide controls (member roles & permissions, teen speed gates, family risk dashboard, priority support, early access to new features) and increases family-member capacity to 10.
Prices are stated in U.S. dollars and may differ in your local currency. Prices may change with at least 30 days' notice; price changes do not affect any billing cycle already in progress.
3-day Pro free trial
New Pro subscribers may be eligible for a 3-day free trial. During the trial you have full access to Pro features at no charge. Unless you cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid Pro subscription at the listed monthly price. You may use the trial only once per Apple ID or Google account.
Auto-renewing subscriptions
Auto-renewal disclosure. Paid FamilyGuard subscriptions automatically renew monthly until cancelled. Your account will be charged at the same monthly rate within 24 hours before the end of the current period unless you cancel auto-renewal at least 24 hours before the end of the current period. You can manage and cancel subscriptions from your Apple App Store or Google Play account settings — not from inside the FamilyGuard app.
Payment
All payments are processed by Apple App Store (iOS users) or Google Play (Android users) under their respective billing terms. We do not receive your full payment card details; we receive only a receipt or purchase token confirming the transaction.
Tax
Subscription fees may be subject to applicable sales tax, VAT, or similar charges, which will be added by Apple or Google as part of the purchase.
04Refunds and cancellations
Cancelling auto-renewal
You may cancel auto-renewal at any time:
- iOS: Settings → [your name] → Subscriptions → FamilyGuard → Cancel Subscription.
- Android: Google Play app → Profile → Payments & subscriptions → Subscriptions → FamilyGuard → Cancel subscription.
After cancellation, your subscription remains active until the end of the current billing period. You will continue to have Pro/Family access until that date, after which your account reverts to Basic.
Refunds
Because all transactions are processed by Apple or Google, all refund requests must be made through them:
- iOS / Apple users: visit reportaproblem.apple.com and request a refund directly from Apple.
- Android / Google Play users: visit play.google.com/store/account/orderhistory and request a refund through Google Play.
We can advise on your refund request but cannot process refunds directly. Granting or denying a refund is at the sole discretion of Apple or Google in accordance with their store policies. Local consumer protection laws may provide additional refund rights.
05Acceptable use
You agree not to use the Service to:
- Track a person without their knowledge and consent.
- Stalk, harass, threaten, intimidate, or harm any person.
- Violate any applicable law, regulation, or third-party right.
- Reverse-engineer, decompile, scrape, or otherwise attempt to derive the source code of the Service.
- Probe, scan, or test the vulnerability of any system or network, or breach any security or authentication measures.
- Send automated requests to our servers in excess of normal app behavior, including any form of denial-of-service or rate-limit evasion.
- Impersonate another person, falsify your identity, or misrepresent your relationship to a family member.
- Resell, sublicense, or otherwise commercialize access to the Service without our prior written consent.
We reserve the right to suspend or terminate any account that violates these rules, with or without notice.
06Safety limitations and disclaimers
READ THIS CAREFULLY. This is the most important section of these Terms.
FamilyGuard provides best-effort predictive alerts. These alerts depend on real-time GPS, mobile data connectivity, third-party weather data, third-party road and hazard data, device sensors (accelerometer, gyroscope), the user's own phone behavior, and software running on a device we do not control that may itself have bugs, battery problems, OS-imposed limits, or connectivity issues. Because of this:
- Alerts may be late — a few seconds, or, in degraded network conditions, much longer.
- Alerts may be missed entirely — for example, if the phone has no cellular signal, the app has been force-quit, the phone's location services were disabled, the phone is in low-power mode, background app refresh is off, or the phone OS killed the app to free memory.
- Alerts may be wrong — weather forecasts are probabilistic; road, intersection, and speed-limit data may be out of date or incorrect at the source; risk scores are statistical estimates that can over- or under-state actual risk at any moment.
- The app may crash, fail to start, or stop working at any time without warning.
- Our servers may be unavailable due to outages, maintenance, or unforeseen failures.
- Voice alerts may not be heard — phone on silent, volume too low, headphones not connected to Bluetooth, music drowning out the alert, the user not listening, the user asleep.
- Push notifications may not be delivered — Apple or Google's push infrastructure can lose messages, rate-limit them, or delay them.
- Crash detection may produce false positives (announcing a crash when there isn't one — for example, dropping the phone on a hard surface, or a rough off-road bump) and false negatives (failing to detect a real crash — for example, low-speed impacts, side-impacts where acceleration is lateral and below threshold, impacts where the phone is not on the user's person, or impacts where the phone was destroyed before transmitting).
- The automatic 9-1-1 call after crash detection can fail to connect, can be intercepted by call-blocking apps, can dial the wrong number due to OS-level routing in some jurisdictions, or can be hung up before a dispatcher answers.
- You or your family member may ignore, dismiss, or disable any alert that does fire.
FamilyGuard is not:
- A replacement for safe, attentive, hands-on driving.
- A replacement for parental supervision of teen drivers.
- A replacement for calling 9-1-1 directly in any emergency.
- A medical device, a first-responder service, a security service, or a monitoring service certified by any government or industry body.
- A guarantee — explicit or implied — that your family will not be harmed in a vehicle crash, weather event, medical emergency, or any other dangerous situation.
- Insurance. We do not pay out claims for accidents, injuries, or property damage suffered while using or relying on the Service.
You acknowledge that you will not rely on FamilyGuard as your sole or primary safety system, and you will continue to teach and practice safe-driving fundamentals (seatbelts, no phone use while driving, defensive driving, weather-appropriate caution, etc.) regardless of what FamilyGuard does or does not warn you about.
Your assumption of risk and release of claims
By using FamilyGuard, you knowingly and voluntarily assume all risks associated with its use — including the risks of bodily injury, death, property damage, emotional distress, and any other loss that may result from a failure of the Service to perform as expected or at all.
To the maximum extent permitted by applicable law, you hereby release, waive, discharge, and covenant not to sue Godhead Safety Consulting LLC, its officers, members, employees, contractors, and agents (collectively, the "Released Parties") from any and all claims, demands, losses, causes of action, damages, lawsuits, judgments, including attorneys' fees and costs, arising out of or related to: (a) any failure of the Service to detect, predict, warn about, or accurately characterize any hazard, including but not limited to weather events, road conditions, speed-limit changes, dangerous intersections, vehicle crashes, or driver behavior; (b) any failure of the Service to deliver an alert, place an emergency call, or notify family members; (c) any false alarm, false positive, or false negative; (d) any inaccuracy in third-party data we rely on (mapping, weather, traffic, road, intersection, or speed-limit data); (e) any action taken or not taken by you or a family member in response to (or in the absence of) an alert; (f) any outage, downtime, bug, or interruption of the Service; (g) any unauthorized access to your account or data; and (h) any other circumstance in which the Service does not perform as you hoped or expected.
This release applies whether the claim arises in contract, tort (including negligence), strict liability, product liability, statutory liability, or any other legal theory, and whether the loss is direct, indirect, incidental, consequential, special, or punitive.
Carve-out for non-waivable claims. Some jurisdictions do not allow a person to release certain claims in advance — for example, claims for gross negligence, willful misconduct, fraud, or personal injury caused by the company's own intentional acts. This release does not apply to any claim that, under applicable law, cannot lawfully be released in advance. Everywhere else, the release is intended to be enforced to the maximum extent permitted by law, and if any portion of it is found unenforceable, the remaining portions remain in full effect.
You also agree not to bring a claim against any Released Party on behalf of any other person, including your minor children, except to the extent doing so is permitted by applicable law and a court determines you have standing to do so. Where you do bring such a claim on another person's behalf, you agree to defend and indemnify the Released Parties from any judgment or settlement to the maximum extent permitted by law.
07Emergency features
FamilyGuard includes an Auto-911 Crash Detection feature that, when enabled and triggered, can place an automatic call to 9-1-1 from the user's phone after a 30-second countdown. The call is initiated by your phone's operating system; FamilyGuard does not place calls directly to emergency services. Successful delivery of the call depends on cellular coverage and on the user not cancelling within the 30-second window.
FamilyGuard includes an SOS button that, when pressed, sends a high-priority alert to every emergency contact in the user's family circle. The SOS button does not automatically call 9-1-1 by itself; it notifies family. Family members are responsible for taking appropriate action (calling 9-1-1, going to the SOS sender's location, etc.) on receipt.
We are not responsible for any failure of these emergency features, including but not limited to delays in alert delivery, inability to reach emergency services, or actions taken or not taken by family members in response to an alert.
08Intellectual property
The Service — including the FamilyGuard name, the "Trisha AI" name, the FamilyGuard logo, all software, design, text, graphics, and user interface — is owned by Godhead Safety Consulting LLC and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes only, subject to these Terms.
You may not copy, modify, distribute, sell, lease, or create derivative works of the Service or any portion of it. All rights not expressly granted to you are reserved by us.
09Feedback
If you send us feedback, ideas, or suggestions about the Service, you grant us a perpetual, worldwide, royalty-free license to use that feedback for any purpose, including incorporating it into the Service, without owing you any compensation. You are not required to send feedback.
10Term and termination
These Terms remain in effect for as long as you use the Service. You can terminate your account at any time by deleting it through the app (Settings → Account → Delete account) or by emailing support@familyguardaiapp.com.
We may suspend or terminate your access to the Service, with or without notice, if (a) you violate these Terms, (b) we are required to do so by law, (c) the Service is no longer commercially viable, or (d) at our discretion. If we terminate your account other than for your violation of these Terms, we will refund any unused, prepaid subscription fee on a pro-rated basis through Apple or Google.

11Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. WE DO NOT WARRANT THAT ALERTS WILL BE DELIVERED ON TIME, BE ACCURATE, OR PREVENT ANY HARM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES; IN THOSE JURISDICTIONS, THE EXCLUSIONS ABOVE APPLY ONLY TO THE EXTENT PERMITTED BY LAW.
12Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL GODHEAD SAFETY CONSULTING LLC, ITS OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION LOSS OF LIFE, PERSONAL INJURY, EMOTIONAL DISTRESS, PROPERTY DAMAGE, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION — ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
13Indemnification
You agree to defend, indemnify, and hold harmless Godhead Safety Consulting LLC, its officers, employees, and agents from any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising out of: (a) your use of the Service in violation of these Terms; (b) your violation of any law or third-party right; or (c) any false, inaccurate, or misleading information you provided through the Service.
14Governing law and disputes
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service that is not subject to the arbitration agreement below will be brought exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.
15Arbitration agreement
Please read this section carefully — it limits how you can pursue legal claims against us.
Mandatory binding arbitration. Except for disputes that qualify for small-claims court and except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will take place in Texas (or, at your election, the U.S. county where you reside, conducted by video conference). Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.
Class-action waiver. You and we agree that any dispute will be brought in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding.
30-day opt-out. You may opt out of this arbitration agreement by sending written notice to support@familyguardaiapp.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. If you opt out, all other provisions of these Terms will still apply.
16General terms
Updates to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page will always reflect the latest version. For material changes, we'll notify you inside the app or by email at least 14 days before the change takes effect. Continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms.
Entire agreement
These Terms, together with our Privacy Policy and any additional terms you accept inside the app, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements on the same subject matter.
Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.
No waiver
Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision later or to enforce any other provision.
Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms to any successor entity in connection with a merger, acquisition, or sale of substantially all of our assets.
Apple App Store / Google Play additional terms
If you obtained the FamilyGuard app from the Apple App Store, you acknowledge that these Terms are between you and Godhead Safety Consulting LLC only — not with Apple — and Apple is not responsible for the app or its content. Apple is, however, a third-party beneficiary of these Terms and may enforce them against you. The same applies to Google for Android users obtaining the app from Google Play.
